Hoams is built to serve your HOA community — not to monetize your personal information. This policy explains exactly what we collect, why, and how we protect it.

Our commitment in plain language: We do not sell your personal data. We do not use your messages or community activity to target you with ads. We do not share your information with third parties for their own marketing. Your HOA community's data belongs to your community — not to us.

Who We Are

Hoams, Inc. ("Hoams," "we," "us," or "our") is a Delaware corporation that operates myhoams.co and related services (collectively, the "Platform"). Hoams provides a communication and community management platform designed exclusively for homeowners associations (HOAs), enabling residents and board members to connect, share information, and manage community matters within a secure, community-scoped environment.

We are not a property management company (PMC), a legal fiduciary, or a governance decision-maker for any HOA. We are a technology service provider. Our Platform is a tool for your community — decisions made using it remain the responsibility of your HOA board and membership.

Scope of This Policy

This Privacy Policy applies to all individuals who use the Hoams Platform, including:

  • Residents — homeowners and renters within an HOA community that subscribes to Hoams.
  • Board Members — elected or appointed HOA board officers who access board-level administrative features.
  • HOA Administrators — community managers or staff acting on behalf of an HOA board.
  • Visitors — individuals who visit our marketing website at myhoams.co without creating an account.

This policy does not apply to third-party websites or services linked from our Platform. If you follow a link to a third-party site, that site's own privacy policy governs.

HOA as Subscriber

The subscribing unit on Hoams is the individual HOA unit (home or property), not the board or community as a whole. When your HOA subscribes to Hoams, individual members join under that community's account. Your HOA board may be the account administrator but does not own your personal data — you do.

Information We Collect

Information You Provide

When you create an account or use the Platform, you may provide:

  • Account registration data: name, email address, unit/address within your HOA, phone number (optional), and a profile photo (optional).
  • Community content: posts to the Community Feed, direct and group messages, document uploads, and announcement responses.
  • Directory information: any profile details you choose to make visible to other community members (see Section 9).
  • Support communications: information you provide when you contact us for help.
  • Feedback and surveys: responses you provide voluntarily about your experience.

Information Collected Automatically

When you access the Platform, we automatically collect limited technical information necessary to operate the service:

What We Do Not Collect

We do not collect biometric data, government-issued ID numbers, financial account or payment details, social security numbers, medical or health information, or location data beyond general region inferred from IP address. We do not build behavioral advertising profiles. We do not track your activity outside the Hoams Platform.

Information from Third Parties

We do not purchase or obtain personal data from data brokers, advertisers, or social media platforms. The only third-party data we may receive is:

  • HOA-provided roster data: your HOA board or administrator may import a member list (names, unit numbers, email addresses) to pre-populate your community. When this occurs, you will be notified via email before your account is activated.
  • Single sign-on (SSO): if we support SSO authentication in the future, you will be informed at that time and given opt-in choice.

How We Use Your Information

We use the information we collect only for the following purposes:

  1. Providing the Platform — delivering the Community Feed, direct and group messaging, member directory, document library, and announcements to your HOA community.
  2. Account management — creating and maintaining your account, verifying your identity within your community, and managing access permissions.
  3. Security and integrity — detecting and preventing unauthorized access, fraud, spam, abuse, and violations of our Terms of Service.
  4. Platform improvement — understanding how features are used in aggregate (not individually profiled) to improve reliability and user experience.
  5. Communications — sending you account-related notifications (password resets, security alerts, policy changes). We do not send promotional emails without your explicit opt-in consent.
  6. Legal compliance — fulfilling our obligations under applicable law, including responding to valid legal process.
  7. Customer support — responding to your questions and resolving issues.

No Advertising Use

We do not use your personal data — including your community communications, documents, or directory information — for targeted advertising. We do not display third-party ads on the Platform. Hoams products are ad-free.

No AI Training on Your Content

We will not use your community's messages, feed posts, uploaded documents, or personal data to train artificial intelligence or machine learning models — for our own use or for third parties — without your explicit, affirmative opt-in consent. This commitment applies to both current and future versions of the Platform.

Information Sharing

We do not sell, rent, or license your personal data. We share information only in the following limited circumstances:

Within Your HOA Community

Information you post to the Community Feed, share in the member directory, or include in community documents is visible to other verified members of your HOA community on Hoams. Direct messages are visible only to the intended recipient(s). Group messages are visible only to members of that group. This is core to how the Platform works — you control what you share within your community.

Service Providers

We work with carefully selected third-party service providers who process data on our behalf — for example, cloud hosting, email delivery, and customer support software. These providers:

  • Are bound by data processing agreements that prohibit them from using your data for any purpose other than providing services to Hoams.
  • Are prohibited from selling, sharing for advertising, or independently using your personal data.
  • Are required to maintain security standards consistent with or greater than our own.

HOA Board and Administrators

Board members and designated HOA administrators have access to community-level administrative functions. Their access is limited to information necessary to manage the community (e.g., member roster, posted announcements). They cannot access your private direct messages or personal account credentials. Board members are bound by the acceptable use provisions in our Terms of Service and may not use administrative access for purposes unrelated to HOA governance.

Legal Requirements

We may disclose information when we have a good-faith belief that doing so is necessary to: (a) comply with a valid legal obligation, court order, or government request; (b) protect the safety of any person; (c) detect, prevent, or address fraud, security, or technical issues; or (d) enforce our Terms of Service or protect our legal rights.

We will notify affected users of legal demands for their data where permitted by law and not prohibited by the order itself.

Business Transfers

See Section 19 for how we handle data in the event of a merger, acquisition, or asset sale.

No Vendor Kickbacks or Marketing Data Sales

We explicitly prohibit board members and administrators from using Hoams data to solicit or receive kickbacks, referral fees, or other compensation from vendors who are mentioned or recommended on the Platform. We do not share member data with third-party vendors for marketing purposes, regardless of any financial arrangement.

Community-Scoped Data

A foundational design principle of Hoams is community scoping: your data is visible only within your verified HOA community, never across communities or to the general public.

  • Community Feed posts are visible only to verified members of your HOA, not to the internet at large.
  • Your member profile is not searchable outside your community.
  • Your HOA's document library, announcements, and communications are isolated to your community.
  • Hoams employees do not read your community's communications except when required to investigate a reported abuse, support ticket, or legal matter — and only with appropriate internal authorization.

Your Community Is Not a Public Forum

Unlike social media platforms, your Hoams community is not public. Content you post to your HOA's Community Feed does not appear in search engines and is not accessible to non-members.

Board Member Responsibilities & Restrictions

Board members and administrators have elevated access on the Platform. This access is a privilege tied to their governance role and is subject to the following binding restrictions:

  • Board access may only be used for legitimate HOA governance purposes — not personal interests, retaliatory conduct, or selective enforcement.
  • Board members may not access, export, or use member data (including email addresses or contact information) to send communications unrelated to HOA business.
  • Board members may not share member data with third parties, including vendors, real estate agents, or political campaigns, without explicit member consent.
  • Board members may not use Hoams data to build external mailing lists or marketing databases.
  • Board administrative actions on Hoams (such as sending community-wide announcements) are logged and may be reviewed by Hoams in connection with a reported abuse investigation.

Violations of these restrictions may result in suspension or termination of board access and reporting to the HOA membership.

Messaging & Content Privacy

Hoams provides Direct Messaging and Group Messaging features. The following privacy principles apply:

  • Direct messages are private between sender and recipient(s). They are not visible to board members, administrators, or other community members.
  • Group messages are visible only to members of that specific group.
  • Community Feed posts are visible to all verified members of your HOA community.
  • Messages are stored on our secure servers to deliver them and maintain your conversation history. We do not apply end-to-end encryption at this time; Hoams infrastructure can technically access message content in connection with security investigations or legal requirements, as described in this policy.
  • We will be transparent if and when end-to-end encryption is implemented for messaging.

Content Moderation

Community Feed content may be reviewed by Hoams in response to reported violations of our Terms of Service (e.g., harassment, Fair Housing Act violations, spam). We do not proactively scan or moderate community content for business intelligence purposes.

Content You Post

You are responsible for content you post on the Platform. Do not share sensitive personal information (your own or others') — such as financial account details, social security numbers, or medical information — through the Platform. Hoams is not designed to store such information and does not take responsibility for personal data you choose to share in messages or posts.

Member Directory Privacy

The Member Directory enables HOA residents to find and connect with neighbors. We take a privacy-first approach to this feature:

  • You control which information appears in your directory profile. Only your name and unit number are displayed by default. Email, phone number, and other details require your explicit opt-in.
  • Directory information is visible only to verified members of your HOA. It is not visible to the general public or to members of other HOA communities on Hoams.
  • You may update or remove your directory information at any time through your account settings.
  • Board members cannot make your personal contact information visible without your consent.

Document Library

The Document Library allows your HOA to store and share community documents (governing documents, meeting minutes, financial reports, etc.). The following applies:

  • Documents uploaded to the library are accessible to all verified members of your HOA community, unless an administrator restricts access to board-only documents.
  • Documents you upload may include personal information (e.g., meeting minutes with member names). You and your board are responsible for ensuring documents comply with applicable privacy laws before uploading.
  • Hoams does not analyze, index for advertising, or extract personal information from uploaded documents.
  • When your community's subscription ends or is terminated, we will provide a reasonable period for document export before deletion (see Section 11).

Data Retention

We retain personal data only as long as necessary for the purposes described in this policy, or as required by law. The following general guidelines apply:

When you delete your individual account, your profile is removed and your name disassociated from historical content within the timeframe above. Some aggregate, anonymized activity may persist in analytics. Note that content others have seen before deletion cannot be unseen — deletion prevents future access, not retrospective recall by other users.

Security

We implement industry-standard security measures to protect your information, including:

  • Encryption in transit (TLS/HTTPS) for all data transmitted between your device and our servers.
  • Encryption at rest for stored personal data and community content.
  • Access controls that restrict employee access to personal data to those with a legitimate need.
  • Routine security assessments and vulnerability monitoring.
  • Secure, redundant cloud infrastructure.

No method of transmission or storage is 100% secure. If you believe your account has been compromised, please contact us immediately at security@myhoams.co.

Data Breach Notification

In the event of a security breach that materially compromises your personal data, we will notify affected users and relevant regulatory authorities as required by applicable law — and in no event later than 72 hours after we become aware of a qualifying breach affecting users in jurisdictions with mandatory notification requirements.

Minors

The Hoams Platform is intended for use by adults (18 years of age and older) who are homeowners, renters, or authorized representatives within a subscribing HOA community.

We do not knowingly collect personal information from individuals under the age of 13. If you believe a child under 13 has provided personal information to Hoams without parental consent, please contact us at privacy@myhoams.co and we will promptly delete such information.

HOA communities that include minors as dependent occupants should be aware that the subscribing unit (the adult homeowner or renter) is the account holder. Minors should not be assigned individual Hoams accounts. Board members should not post identifying information about minor residents in community communications.

Your Rights & Controls

You have the following rights with respect to your personal data on Hoams:

  • Access: You may request a copy of the personal data we hold about you.
  • Correction: You may update or correct your account information at any time through your account settings.
  • Deletion: You may request deletion of your account and personal data. See Section 11 for retention timelines.
  • Portability: You may request a machine-readable export of your account data and community content you created.
  • Restriction: You may request that we restrict processing of your data in certain circumstances.
  • Objection: You may object to certain processing activities, including any future use of your data for product analytics profiling.
  • Opt-out of promotional communications: You may unsubscribe from any optional promotional or marketing emails at any time via the unsubscribe link or through account settings. Transactional and security-related emails cannot be opted out of while your account is active.
  • Do Not Sell / Do Not Share: We do not sell or share your personal data for cross-context behavioral advertising. If our practices ever change, we will update this policy and provide opt-out mechanisms before any such activity begins.

To exercise any of these rights, contact us at privacy@myhoams.co. We will respond within 30 days (or the timeframe required by applicable law). We may ask you to verify your identity before fulfilling your request.

Community Data vs. Personal Data

Some data on the Platform — such as community announcements, board meeting minutes, or community rules — is community property managed by your HOA. Your right to delete this content may be limited by your HOA's own governance policies and governing documents. Hoams will follow your HOA board's instructions regarding community-level content management, while honoring your individual data rights with respect to your personal account data.

Cookies & Analytics

We use a minimal set of cookies and similar technologies to operate the Platform:

Our marketing website (myhoams.co) may use analytics tools (such as privacy-respecting alternatives to Google Analytics) to understand site traffic. These tools are configured to anonymize IP addresses and not retain personally identifiable information.

We do not use pixel tracking, fingerprinting, or tracking technologies that identify you across other websites.

Fair Housing Act Compliance

Hoams is designed in compliance with the Fair Housing Act (FHA) and applicable state fair housing laws. We take these obligations seriously:

  • We prohibit use of the Platform to discriminate against any person on the basis of race, color, national origin, religion, sex, familial status, disability, or any other class protected under federal, state, or local fair housing laws.
  • Board members and administrators may not use member directory data, demographic information, or platform communications to facilitate discriminatory policies, selective enforcement, or biased treatment of community members.
  • We do not collect or expose demographic data (race, ethnicity, national origin, religion, familial status, disability) as part of member profiles or community features.
  • Community Feed and messaging content that violates fair housing law is subject to removal upon report and may result in account suspension.
  • We maintain records of reported fair housing violations for a minimum of three years to support regulatory inquiries.

Hoams is not a legal advisor. If you believe a fair housing violation has occurred in your community, you should contact your local Fair Housing agency, the U.S. Department of Housing and Urban Development (HUD), or a qualified attorney.

HOA Disputes & Our Neutral Role

Hoams is a communication and management platform — not a mediator, arbitrator, or governance authority for your HOA. We take a deliberately neutral position in HOA disputes, including:

  • Dues and assessment disputes: We do not adjudicate disputes between members and their HOA over dues, special assessments, or fees. Member financial data remains scoped to the community's financial administrators and is not reviewed by Hoams in connection with a dispute.
  • Violation proceedings: We do not participate in HOA violation or enforcement proceedings. Records of community communications on Hoams may be subject to legal discovery in proceedings, as with any electronic communication platform.
  • Board elections: We do not influence, endorse, or validate HOA board elections. If voting features are added in the future, they will be designed for neutrality and auditability.
  • Governance decisions: Content posted on the Platform does not constitute legal notice under any HOA's governing documents unless your HOA has separately adopted such a policy.

Hoams is not a licensed property management company and does not hold fiduciary duties to HOA members or boards. Our obligations are those of a technology service provider.

AI Features, Benchmarking & Aggregate Analytics

AI Features

If Hoams introduces AI-assisted features in the future (such as smart search, content summarization, or community insights), we will:

  • Disclose clearly which features are AI-assisted.
  • Not use your personal data or community communications to train AI models without explicit opt-in consent (see Section 4).
  • Provide opt-out mechanisms for any AI-assisted features that process personal data.

Aggregate Benchmarking

If Hoams offers community benchmarking features (e.g., comparing community metrics against anonymized averages), the following privacy protections apply:

  • Benchmarking data is derived only from aggregated, de-identified community information.
  • We apply a minimum pool size (k-anonymity, k≥5) to ensure no individual community or member can be identified from any reported aggregate metric.
  • No individual-level data is exposed to other communities or to Hoams for commercial purposes through benchmarking features.
  • Participation in benchmarking programs is opt-in at the HOA community level.

Business Transfers

If Hoams is involved in a merger, acquisition, restructuring, bankruptcy, or sale of all or a portion of our assets, your personal data may be transferred to the successor entity as part of that transaction.

We commit to the following in any such event:

  • We will notify you via email and/or a prominent notice on the Platform at least 30 days before your data is transferred to a new entity, where practicable.
  • Any successor entity will be bound by privacy commitments no less protective than those in this policy, or you will be given the opportunity to delete your account and data before the transfer takes effect.
  • We will not sell your personal data as a standalone asset in any bankruptcy or liquidation proceeding.

State-Specific Privacy Rights

Depending on where you live, you may have additional rights under state law:

California (CCPA / CPRA)

California residents have the right to know, correct, delete, and opt-out of the sale or sharing of their personal information. As stated throughout this policy, we do not sell personal information. California residents may also designate an authorized agent to submit rights requests on their behalf. To exercise your rights, contact privacy@myhoams.co with "California Privacy Request" in the subject line.

Virginia (VCDPA), Colorado (CPA), Texas (TDPSA), and Other States

Residents of states with comprehensive privacy laws have rights to access, correct, delete, and port their personal data, and to opt-out of the processing of personal data for targeted advertising (which we do not engage in). We honor these rights for all users regardless of residence. Contact privacy@myhoams.co to submit a request.

State HOA Privacy Laws

Many states have specific laws governing HOA records, member data access, and board obligations. Hoams is designed to support HOA compliance with applicable state law by providing tools for transparent communication and record-keeping. However, your HOA — not Hoams — is responsible for complying with state HOA statutes as they relate to member records and governance. Hoams is not a legal advisor.

International Users

Hoams is currently offered to HOA communities in the United States. Our Platform is operated from servers located in the United States. If you access the Platform from outside the United States, your data will be transferred to and processed in the United States.

If we expand to serve users in the European Economic Area, the United Kingdom, or other jurisdictions with data transfer restrictions, we will implement appropriate safeguards (such as Standard Contractual Clauses or equivalent mechanisms) and update this policy accordingly.

Policy Changes

We may update this Privacy Policy from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page.
  • Send an email notification to registered users at least 14 days before the changes take effect.
  • Post a prominent notice on the Platform.

For non-material changes (e.g., clarifications, corrections, formatting), we will update the policy without advance notice. Your continued use of the Platform after the effective date of any updated policy constitutes your acceptance of the revised terms.
